Terms & Conditions

By using the Kopon website or app ("the user", "you"), you agree to these Terms & Conditions. If you do not agree, please do not use Kopon.

1. Definitions

• Kopon — the group-deals marketplace operated in Harare, Zimbabwe
• Voucher — the code issued for a deal once purchased, redeemable with the Vendor
• Vendor — the business supplying the goods or services behind a deal
• Deal — a discounted offer listed on Kopon, subject to a stock limit

2. General

Kopon gives users online access to discounted deals redeemable with Vendors. To purchase a deal you must register an account. You must be at least 18 years old and legally able to enter into binding contracts to register or purchase. Your Kopon account is personal to you and may not be transferred. We may amend these Terms at any time; the current version is always available on this page.

3. Your account

You're responsible for the accuracy of the information you give us, and for keeping your password confidential. You're responsible for all activity on your account and must notify us immediately of any unauthorised use. Kopon may suspend or terminate accounts found to contain false information or engaged in fraudulent activity.

4. Conduct

You may not post or send content through Kopon that is unlawful, discriminatory, obscene, defamatory, infringes another's rights, or contains harmful code. You may not use Kopon to solicit users to competing services.

5. Copyright & trademarks

All content on Kopon is our property or used with permission. You may not copy, reproduce, republish or distribute any part of the site or its content without our prior written permission. If you submit content to Kopon (e.g. reviews), you grant us a royalty-free, worldwide licence to use, reproduce and publish it in connection with our services.

6. Limitation of liability

Kopon acts as an intermediary between you and Vendors and is not liable for the Vendor's performance of the underlying goods or services. Save where liability cannot lawfully be excluded (including under the Consumer Protection Act), Kopon and its staff will not be liable for indirect, consequential or incidental damages arising from your use of the site. Kopon is provided "as is" and "as available," without warranty that the service will be uninterrupted or error-free. Kopon is not liable for events beyond its reasonable control (force majeure).

7. Indemnity & termination

You agree to indemnify Kopon against claims arising from your misuse of the service or breach of these Terms. We may terminate your account if you request it, if required by law, if there is fraudulent or illegal activity on it, or if these Terms are breached.

8. Governing law

These Terms are governed by the laws of Zimbabwe, and disputes are subject to the jurisdiction of the Zimbabwean courts.

9. Terms of sale — deals & vouchers

• Vouchers are redeemed with the Vendor, not with Kopon.
• Kopon is an intermediary; the Vendor is solely responsible for honouring the deal and providing the underlying goods or services.
• Deal stock is limited. If a deal sells out before your purchase completes, the deal will no longer be available to you.
• Vouchers, and their reference codes, are your responsibility — Kopon and the Vendor are not liable for lost or stolen vouchers.
• Vouchers may not be resold or duplicated except as permitted by law, and are void if these Terms or the Vendor's own terms aren't met.
• Vouchers must be redeemed before their stated expiry date, which cannot be extended.
• Refund requests are handled case-by-case with the Vendor; Kopon will confirm a voucher is unredeemed before processing any approved refund.
• If goods or services don't meet the standards required by the Consumer Protection Act [Chapter 14:44], you may ask the Vendor to repair, replace or refund within a reasonable period after delivery.
• If a deal is listed at an incorrect price due to error, we'll notify you and refund any amount already paid rather than honour the incorrect price.
